What is a 106 Agreement? |
It is a planning agreement.
It allows for the landowner and planning authority to agree howa piece
of land is used.
Often these Agreements are linked to major planning applications such as
housing developments. |

What is the purpose of a 106
Agreement? |
A 106 Agreement is put in place to
regulate the use or development of a piece of land and usually imposes
particular obligations on the landowner. |

Is a 106 Agreement a legal
requirement? |
No it is a voluntary agreement but, once
in place, it is legally binding. |

Can a 106 Agreement be changed once
it has been put in place ? |
Yes, if circumstances demand, a 106
Agreement can be varied with the approval of both parties. |

Who writes a 106 Agreement? |
The legal representatives of both the
landowner and the planning authority will draw up an agreement to which
both parties must add their signature before it is binding. |
The 106 Agreement between
Thanet District Council and Planestation
Thanet District Council and Planestation,
operators at Kent International Airport, Manston are renewing the 106 Agreement
to keep pace with the Airport’s development.
This is a voluntary move on the part of the Airport who have expressed a wish to
work in partnership with the Council to reach an Agreement that will provide
safeguards for the environment of Thanet and its community.
A 106 Agreement has been in existence for some years, between the Council and
the Landowners at Manston Airport. However, the introduction of scheduled
passenger flights and the construction of a large cargo facility means that
circumstances have changed to an extent, where we need to undertake a review.
The Council has more information now about the likely impact of passenger
flights, the type of aircraft that will be using the Airport and the associated
noise levels. And we want to make sure that the 106 Agreement is relevant both
to today’s situation and the next three years.
For the next three months, as part of this review, we will be consulting the
community on all of the issues that will affect the drafting of the new 106. At
the end of that period the data will be analysed and used to inform the final
agreement which we plan to publish in the Autumn of 2005.
